Kimme Barred from Spending Topinka’s Funds

Chicago, Fri., Jan 22, 2016 — Cook County Circuit Judge Anna Helen Demacopoulos today barred Springfield lobbyist Nancy Kimme from spending any funds from the late Illinois Comptroller Judy Baar Topinka’s political committee bank account.

“No funds in the account of Citizens for Judy Baar Topinka shall be expended except for defense of this case by the fund, and with / or by the agreement of counsel, court order or both,” said Judge Demacopoulos in entering a temporary restraining order.

With no authority from the Topinka family to do so, Kimme assumed control of her mentor’s political committee and its nearly $900,000 in assets days after Comptroller Topinka’s December 10, 2014 death.

Judy Baar Topinka was one of the first two Illinois Republican women elected statewide, the first Republican woman nominee for Governor in 2006 and the re-elected Illinois Comptroller at the time of her unexpected passing. She also served as Illinois Treasurer, a member of the Illinois General Assembly, a director of the Regional Transportation Authority and the state GOP chairman. Her legacy is widely regarded as a common sense, inclusive, non-partisan determination for people in government to work together to solve problems while having fun in the process.

In the press release announcing this lawsuit to reclaim the political committee bank account, plaintiff Joseph Baar Topinka cited his mother’s “joyful exuberance” and “irrepressible spirit toward Illinois and its citizens.”

Joseph Topinka, Comptroller Topinka’s only child and the executor of her estate, said the four-count suit was prompted by one year of attempts by himself, his attorney and others to reach Kimme that brought no resolution to his insistence that his mother’s political contributions be used to fund the Judy Baar Topinka Charitable Foundation, which was established in 2015.

“The issuance of a court order today prohibiting expenditure of funds held by Citizens for Judy Baar Topinka Committee without a court order was a victory for Joseph Topinka and donors to the committee. Improper and unauthorized use of the funds by Nancy Kimme will no longer be allowed,” said Anthony Peraica, attorney for Joseph Topinka, and longtime friend of the Topinka family.

“The Topinka motion for temporary restraining order is entered,” Judge Demacopoulos said.

The case, Joseph Baar Topinka, et al v. Nancy Kimme, et al, 15–CH–18684, was filed December 29, 2015. Its next hearing is scheduled for March 15 at 2 p.m. in Room R-2008 of the Daley Center.
